Acceptance of Terms

By submitting an application through www.wingsweblab.org (the "Site") or otherwise engaging with Wings Web Lab's services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Site or submit an application.

Description of Service

Wings Web Lab provides website design, redevelopment, and one-on-one training services free of charge to eligible small businesses and grassroots non-profit organizations, as described on our Our Mission page. Applicants remain responsible for any third-party costs associated with their website, such as domain registration and hosting fees, as described on our FAQ page.

Application & Selection

Submitting our intake application is a request for services, not a guarantee of acceptance. Wings Web Lab reserves the right to:

• Set and change our own eligibility criteria;
• Accept, decline, waitlist, or defer any application at our discretion; and
• Limit the number of projects we take on based on our available capacity.

We endeavor to notify all applicants of their review status by email within 14 business days of receiving a completed submission.

Client Responsibilities

If your application is accepted, you agree to:

• Provide accurate and complete information about your organization;
• Confirm that you own or have the legal authority to modify your domain name and existing website content, if applicable;
• Pay any third-party costs required to keep your website live (domain registration, hosting, or platform fees), as we do not cover these; and
• Participate in the training component of the program in good faith, as described in our "Learning Guarantee."

Authorization to Access Client Platforms

Some projects require Wings Web Lab to directly access a client's existing website backend (for example, an existing Squarespace, Wix, or other content management system account) in order to complete the rework. By accepting our services for such a project, you grant Wings Web Lab explicit, temporary permission to access and modify your website through that platform for the sole purpose of completing the agreed-upon rework. We may require separate written token confirmations prior to credential sharing.

Intellectual Property

Upon completion and hand-off of a website rework, ownership of the final website design, code, and content created specifically for your organization transfers to you. Wings Web Lab retains the right to reference completed projects, including screenshots and general descriptions of the work performed, in our own portfolio and marketing materials (such as our Before & After page), unless you request otherwise in writing.

No Warranty

Wings Web Lab provides its services on an "as-is" and "as-available" basis. As a volunteer-driven, community digital equity initiative, we do not guarantee that any website we build will be uninterrupted, error-free, or achieve any particular business outcome. We do our best to deliver stable, functional, mobile-friendly websites, but we make no warranties, express or implied, regarding the services provided.

Limitation of Liability

To the fullest extent permitted by law, Wings Web Lab and its team members will not be liable for any indirect, incidental, or consequential damages arising from our services, including but not limited to lost data, lost revenue, or downtime, whether arising during a website rework or afterward. Because our services are provided entirely free of charge, our total collective liability under any circumstances will not exceed $0.00.

Termination

Either party may discontinue a project at any time by written or email notification to the other. If a project is discontinued midway, any partial assets hosted on Wings Web Lab systems remain our property, while full credential access to your original platforms will be securely transferred back to your sole possession.

Governing Law

These Terms & Conditions are governed by the laws of the State of Massachusetts, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms & Conditions from time to time. When we do, we will update the "Effective date" at the top of this page. Continued use of the Site or our services after changes are posted constitutes acceptance of the revised terms.
